CONTRACT SPECIFICATIONS

6. Description of the contract
The scope of Contractor’s work covers the following construction works elements: Constructional works in Palilula – reconstruction of Amphitheatre in city park“.
Subject and estimate of works covered by all the work on the arrangement, ground clearance and adapted the old contents of the plateau, an adaptation of the tap, leveling the ground surface, installation of park benches, installation of piles of wooden seats in the auditorium or Amphitheatre, and replacement of concrete basis with seats for spectators.
Papers relating to clearing the ground, creating footpaths that line the curbs and gravel of granite cubes. Parts that are damaged previous works, to enhance by planting seedlings, sow grass surfaces and their subsequent care. The whole eastern part of the memorial park "Drums" and provided the organization, or repair the amphitheatre which is of great importance for various cultural events and performances, plateaus with benches for rest and recreation, maintenance of school hours in nature and recreation. In addition to all these works are envisaged rehabilitation and conservation and restoration works on the pyramidal monument of dressed stone. The implementation of the contract shall be executed with full compliance with the description of the main project which is an integral part of tender documentation. The main project includes explanatory notes, bill of quantities and design drawings.

TERMS OF PARTICIPATION

8. Eligibility and rules of origin
Participation is open to all legal persons participating either individually or in a grouping (consortium) of tenderers which are established in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the programme under which the contract is financed (see also heading 22 below). All works, supplies and services under this contract must originate in one or more of these countries. Participation is also open to international organisations. The participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed.

9. Grounds for exclusion
Tenderers must submit a signed declaration, included in the Tender Form for a Works Contract, to the effect that they are not in any of the situations listed in point 2.3.3 of the Practical Guide to contract procedures for EU external actions.

10. Number of tenders
Tenderers may submit only one tender per lot. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than one lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the works required in the tender dossier.

11. Tender guarantee
No tender guarantee is required.

12. Performance guarantee
The successful tenderer will be asked to provide a performance guarantee of 5 % of the amount of the contract at the signing of the contract. This guarantee must be provided together with the return of the countersigned contract no later than 30 days after the tenderer receives the contract signed by the Contracting Authority. If the selected tenderer fails to provide such a guarantee within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next cheapest compliant tender.

Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.

SELECTION AND AWARD CRITERIA

16. Selection criteria
Economic and financial capacity of candidate:
The average annual turnover of the tenderer in the past 3 years (2011, 2010 and 2009) must be at least three times of the financial offer for the tendere.
Technical and professional capacity of candidate:
a) The tenderer should have at least 10 employed on a permanent or temporary basis staff on its rolls

b) The tenderer (consortium as a whole or sole tenderer) must have the capacity to carry out at least 70% of the Contract Works by his own resources, which means that it must have the equipment, materials, technical expertise, know-how and the human and financial resources necessary to enable him to carry out this percentage of the Contract.

c) The tenderer shall have employed on a permanent or temporary basis, the following key personnel:
One Contract Manager: shall be a qualified civil engineer with at least 10 years of relevant project management experience.
One Site Manager: shall be a qualified engineer with at least 7 years of relevant site management experience and/or project management of at least two projects with a similar nature and size as the scheme(s).
One Safety Manager: shall be qualified with at least 3 years experience of “health and safety management” in works of similar nature.
One Quality Assurance/Quality Control Manager: shall be qualified civil engineer or equivalent with at least 3 years practical experience in procedures of works and material testing and document management.
The tenderer shall submit along with its offer the CV’s and copies of diplomas, and relevant proof documents related to the professional experience of the key personnel (e.g. contracts of employment, reference letters etc).

d) The tenderer shall be registered in accordance with its National Legislation for the type of works and designs/project planning foreseen.

Technical capacity
a) The tenderer (consortium as a whole or sole tenderer) has successfully completed at least 2 projects of similar nature and complexity (comparable to the works to be carried out under this tender) of at least 200,000.00€ each;

b) The tenderer should have a minimum of 5 years of experience in the construction business.The tenderer shall supply copies of the respective certificates of provisional or final acceptance issued by the Supervisors/Contracting Authority of the projects concerned or a written letter of satisfaction from the Employer, Clients of that Contract.

• The tenderer should have a minimum of 5 years of experience in the construction business
• he must have the necessary technical capacity, i.e. machines, equipment, to prove that he can fulfil the works. if the tenderer hasn’t got the necessary equipment he has to declare that he will hire it.

18. How to obtain the tender dossier
The tender dossier is available at the premises of the Contracting Authority, address as in point 5 above. Tenders must be submitted using the standard tender form included in the tender dossier, whose format and instructions must be strictly observed.
